Interesting read. As far as I can see, no use of the school logo or mascot, just the colors, opposing mascot and date of the game.

Just goes to show it doesn't have to be cut and dried to still be at risk of a lawsuit.

Anyone can sue anybody over just about anything. Winning is another matter. Then again, having the resources to fight, and having to spend the time and money...

Bingo. In order to get to the winning or losing, you're going to have to spend money.

The issue for many of us here is to not think that just because you didn't use the team name or logo that you aren't going to be the target of a lawsuit. Especially with sports stuff, there's lots of this kind of skirting of the line with the intent to make someone think of a specific team.

This kind of discussion has taken place here plenty of times. I just posted this as an actual example of where you can get sued just by being in the grey area.

My family had a store at a university. I can tell you from experience some guard their copyright like pitbulls. Well, perhaps it isn't the copyright they are worried with, but the money they aren't getting. At least some universities will sue if you use the state name in the school colors, whether it is in the same font or not. The university of Alabama has trademarked the script A. So, anything that has an A on it in script, regardless of color, is subject to lawsuit. More than once, we had people from the uni come in and demand we remove products immediately because they were not licensed. And there are a couple of instances when a product was licensed, but the university said "We didn't know he was going to do THAT. Remove it." . . . and we did.

That would be trademark, not copyright. Different concepts, different rules.
