I make a calendar every year for my dog forum. I always ask members if they would like to have their dog in the calendar. And if so, I have a place for them to post the picture they want in the calendar. They know that the calendars will be up for sale by them and the general public. I've never had any problems. Until know. I have a disgruntled ex global moderator, because I had to ban them. So the person made a complaint against my shop because his dog's picture was in one of the calendars. Claiming copyright infringement. I took the calendar out of my shop. So my question is how do I prevent this happening the next time someone gets mad at me and decides to do this?
For the best legal advice, consult with a lawyer. But at a minimum, you would want something in writing from the owner of the dog and the person who took the picture (if they are different) giving you permission to use the photo in items for sale to the general public.
Yes- you need a Property Release (animals are considered property for this purpose) saying that the person owns the identified property and grants you permission to use image(s) of it without compensation. Signed and dated.. not sure if I can find my file copy.
Thanks AKJeff and BGryphon. How would I word it? And would it be ok for them to email it to me? Or would I need them to sign a form and then send it to me via regular mail? Sorry about all the questions. I justwant to make sure I do it right.
