One of my designs was flagged today for using the word "Caution". Seems there is a company named "Caution!" that objected.

Well perhaps we should be filled in. I mean this is a blocked search term (check it out). So insane as it sounds it doesn't appear to be a joke.

You can search this forum for "caution" and you will find many threads which explain what the issue is. Basically, it's a man with a very heavy hand when it comes to trademark enforcement.

Best place to start is with a forum search:

FIND > "Caution"

Many points, angles, discussions, tangents, lessons learned, advice, suggestions, opinions and more can be found in the results. Lots of interesting conversations have come up over time.

For the record, correct, a "search" in the marketplace will not return results (as in product results). A forum search brings back discussions about it.

Yes I can see the background now. Well I suppose it's up the CP if they want to ban the word from T-shirts. But I think it's probably taking CUP too far and there are certainly other POD sites that have not kowtowed to such ridiculous demands.

Well yeah... proving trademark infringement involves proving consumer confusion (that consumers would think your Caution design is sponsored by or affiliated with "the Caution guy"), stealing "goodwill" from the trademark holder, and / or diluting his profits.

I doubt that very many designs using the word Caution would be defined as an infringement against Caution Guy.

Heh... well caution in spanish is precaution Think its spelled just like that too.

True. Still thinking about it, I don't suppose we don't know all the ins and outs of this and if the guy is making false claims the shoe might be on the other foot.

If you try a google search on caution trademark, you'll come up with a whole bunch of hits to peruse. And yea, I came in and asked about the CUP on that when I first started.
