Hi all,

I understand I can't make money selling clothes using trademarked images, but what about using these images in T-shirts only for my personal use?

Nope. Even if you aren't selling it, CafePress is making money when you buy it.

ooops,

the fact is that I ordered a t-shirt including a fair use drawing I did of an animation character. I received an e-mail confirming me that the order was shipped but my image basket has been flagged in red, even a photo I did of my wife Confused

Then I have two questions

- is possible that CF has printed my design and then flagged the image? or I'm going to receive a blank T-shirt?

- how I can't use photos I did (not including trademarks) whithout being flagged?

Do you mean CP? No, you won't get a blank product... you'll just get no order at all or just the product/s that could be printed.

You can use photos - we have shopkeepers that do it all the time. What image being flagged are you concerned with?

If you took a photo of Britney Spears - that won't fly - she is entitled to her likeness being used only with permission just as anyone else. It's *possible* that perhaps the image of your wife was flagged because it wasn't clear it was personal and likely to be permitted... after all, you already had one image that was suspected as an infringement. CafePress may not have had an obvious indication your wife was a willing, permitted model. We all have our rights to not be used commercially.

As always you can email CUP@CafePress.com and ask... be sure to point out the order number or the images in question. If permissions need to be gained they can let you know. However, my best pre-coffee guess is that one suspected infringement caused them to suspect the other.

Being red-flagged can be just a temporary, holding pattern. It means that CafePress has either determined it to be an infringement OR they need more to go on and hope you'll supply the necessary info to demonstrate your images ARE permitted for commercial use. Just email them and work it from there.

ouch, yes, i mean CP Bonk ^^

but my order is shipped yet and I'm concerned because the first e-mail I received was saying this:

but the e-mail I received confirming the order was shipped says this:

After receiving the second one I noticed my images had been red-flagged but the order was shipped yet, that's why I'm concerned about it.


I understand the photo issue, but what I would need to do to demostrate I have permission to use the photo? I'll upload the photo again later and link it so you can see it.

These are the types of questions that CP has to answer. We're just shopkeepers and not the decision makers in this process. I hope you get it worked out.
