I am creating a new affiliate website to drive traffic to my favorite designs. I have read a ton of forum posts and FAQs on this and I understand the basics of how the process works and how to create links. I've created my website and everything is ready to go, but I ran across some questions when reading the terms & conditions before submitting my site to CJ:

1) From the "Special Terms and Conditions"

quote:

(7) Your Responsibility for Your Agents... You will ensure that Your Agents agree to terms and conditions that are at least as restrictive as the PSA and these Terms and Conditions, subject to applicable law, and shall include a provision in such terms and conditions that CafePress is a third party beneficiary.


My website is just a collection of designs that I like. This seems to imply that I need a big complicated terms and conditions for the website, and I need to get users to read it and agree to it! When I've looked at other affiliate websites, I haven't seen such a terms & conditions.

2) From the "Service Agreement"

quote:

You agree to: ... (iii) maintain a privacy policy on Your Web site and for any non-Web site based promotional method made available to Visitors


So I need a privacy policy? Again, many of the affiliate sites I've looked at do not have this.

3) From the "Special Terms and Conditions"

quote:

(5) Prohibited Affiliate Links... You may not use affiliate links to promote Your own CafePress.com products or CafePress.com Store.


This phrasing implies that under no circumstances should you create affiliate links to your own products. However, the linking FAQ describes how to create affiliate links to your own products! I do understand that you're not allowed to double-dip with affiliate links, but this seems to be saying you shouldn't link to your own stuff under any circumstances at all.

4) Am I supposed to identify myself as an affiliate in some way? Right now my whole website is just a good domain plus some designs that I like and that's it.

Thank you very much for any help you can give me about these questions. I recognize that many of these questions are technical and that members of this forum are not lawyers qualified to give legal advice. I'm not looking for legal advice; I'm looking for advice from affiliates about whether these things have been issues for them, and whether I'm being overly paranoid.
